“Specific Booking Conditions” means any additional or specific payment, cancellation, itinerary, participation or other conditions communicated to the Guest for a particular Service and applicable to that Booking.
2BOOKING & PAYMENT
2.1. Booking Confirmation
A Booking is considered confirmed only after the required deposit or payment has been received and written confirmation has been provided by Eudaimonia.
Availability is not guaranteed until the Booking has been confirmed by Eudaimonia.
By confirming a Booking, the Guest accepts these General Terms & Conditions and any Specific Booking Conditions applicable to the selected Service.
2.2. Payment
Payment terms may differ depending on the particular Service.
The applicable payment schedule, including any deposit amount and payment deadlines, will be communicated to the Guest at the time of Booking or in the relevant Booking confirmation.
Unless otherwise stated in the Specific Booking Conditions or Booking confirmation, all applicable payment deadlines must be respected.
Failure to make payment by the applicable deadline may result in cancellation of the Booking and forfeiture of any deposit already paid, where applicable.
2.3. Deposit
Unless otherwise stated in the Specific Booking Conditions or Booking confirmation, a deposit is required to secure the Booking.
Unless otherwise stated in writing, deposits are non-refundable.
2.4. Remaining Balance
The remaining balance must be paid by the deadline stated in the Specific Booking Conditions, Booking confirmation or specific trip offer.
Where the remaining balance is not received by the applicable deadline, Eudaimonia may cancel the Booking in accordance with the applicable payment and cancellation conditions.
2.5. Payment Methods
Payments may be made by bank transfer, cash or another payment method expressly agreed with Eudaimonia.
2.6. Currency and Bank Fees
Prices are normally stated in EUR unless otherwise specified in the relevant Booking or Service description.
Any bank charges, international transfer fees, currency conversion fees or other charges imposed by the Guest's bank or payment provider are the sole responsibility of the Guest, unless otherwise agreed in writing.
2.7. Confirmed Price
Prices and payment conditions applicable to a specific Booking will be those confirmed in writing by Eudaimonia.
Unless explicitly stated otherwise, the price includes only the Services specifically listed in the relevant Service description, Booking confirmation or Specific Booking Conditions.
2.8. Additional Services
Any additional Services, activities, upgrades, meals, transfers or other services requested after the original Booking may incur additional charges.
Such charges will be communicated to the Guest before confirmation whenever reasonably possible.
3CANCELLATION, TRANSFER & REFUNDS
3.1. Cancellation Conditions
Cancellation and refund conditions may vary depending on the particular Service.
Where Specific Booking Conditions containing cancellation or refund provisions have been provided to the Guest, those conditions shall apply to the Booking.
Unless otherwise stated in the Specific Booking Conditions or agreed in writing, deposits are non-refundable, particularly where Eudaimonia has already committed funds to accommodation, transportation, activities, suppliers or other third-party Services on the Guest's behalf.
3.2. Cancellation by the Guest
If the Guest wishes to cancel a Booking, the cancellation must be communicated to Eudaimonia in writing.
Any refund will be determined in accordance with the cancellation conditions applicable to that Booking and may take into account non-refundable costs already incurred by Eudaimonia or its third-party service providers.
3.3. No-Show, Late Arrival & Early Departure
Unless otherwise stated in the Specific Booking Conditions or agreed in writing, no refund will normally be provided for:
- failure to arrive for the Booking;
- late arrival;
- missed transfers;
- missed activities;
- early departure;
- unused accommodation, meals, activities, transfers or other Services;
- changes to the Guest's personal travel plans; or
- failure to provide required travel documents.
3.4. Transfer of Booking
Where operationally possible, a Guest who is unable to participate may request to transfer their Booking to another person.
Any transfer is subject to Eudaimonia's prior written approval, availability and any applicable costs charged by accommodation providers, transport operators or other third parties.
A transfer is not guaranteed and may not be possible for all Services.
The replacement Guest must provide all information and documentation required by Eudaimonia and must comply with all applicable participation and travel requirements.
3.5. Refund Processing
Where a refund is approved under the applicable cancellation conditions, it will normally be processed using the original payment method, unless otherwise agreed.
Any non-refundable bank, payment-processing or third-party fees may be deducted from the refund where applicable.
4ITINERARY, ACCOMMODATION & CHANGES
Eudaimonia carefully plans each Service; however, itineraries and arrangements may need to be adjusted due to weather, ocean conditions, availability, operational circumstances, local regulations, safety considerations or circumstances beyond our reasonable control.
Accommodation, transportation providers, activities, restaurants, guides or other third-party service providers may occasionally need to be changed.
Where reasonably possible, Eudaimonia will provide an alternative of a similar nature or value. However, a specific accommodation, activity, restaurant, boat or service provider cannot always be guaranteed.
Changes to an itinerary do not automatically entitle the Guest to a refund where the change is caused by circumstances beyond Eudaimonia's reasonable control or where a reasonable alternative is provided, subject always to any rights the Guest may have under the applicable Specific Booking Conditions or mandatory applicable law.
5WEATHER, OCEAN CONDITIONS & FORCE MAJEURE
Many Eudaimonia Services take place in or around the ocean and are therefore dependent on weather and sea conditions.
Activities such as snorkelling, diving, boat trips, fishing, sandbank visits, wildlife encounters and other marine activities may be modified, postponed, shortened or cancelled where conditions are considered unsafe or unsuitable.
Relevant factors may include:
- strong winds;
- rough seas;
- strong currents;
- poor visibility;
- storms;
- heavy rainfall;
- dangerous tides;
- marine warnings or restrictions;
- government or local authority instructions; or
- other environmental or safety conditions.
Eudaimonia may also be affected by circumstances beyond its reasonable control, including but not limited to natural disasters, severe weather, government regulations or restrictions, political unrest, pandemics or public-health measures, transport disruptions, airline or speedboat cancellations, supplier failures, changes in travel regulations or other events that could not reasonably have been prevented or anticipated.
In such circumstances, Eudaimonia may modify the itinerary, change accommodation or activities, postpone or reschedule Services, offer an alternative arrangement or, where appropriate, offer a credit or other reasonable solution.
Additional costs resulting from such changes may be payable by the Guest where they arise from circumstances beyond Eudaimonia's reasonable control, subject to any rights provided under the applicable Specific Booking Conditions or mandatory applicable law.
6LIABILITY
Eudaimonia undertakes to organise and arrange Services with reasonable care.
Certain Services are provided by independent third-party providers, including accommodation providers, boat operators, transport companies, restaurants, activity providers, guides and other local partners.
To the extent permitted by applicable law, Eudaimonia is not responsible for losses, delays, cancellations, injuries, damages or additional expenses caused by the acts or omissions of independent third parties or by circumstances beyond Eudaimonia's reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
The Guest acknowledges that participation in travel and outdoor activities, particularly ocean-based activities, involves inherent risks.
Guests are responsible for following reasonable safety instructions provided by Eudaimonia, local guides, boat crews, accommodation providers and other service providers.
7HEALTH & PARTICIPANT RESPONSIBILITY
The Guest is responsible for ensuring that they are physically and otherwise able to participate safely in the activities included in their Booking.
The Guest should inform Eudaimonia in advance of any medical condition, injury, allergy, dietary requirement or other circumstance that may reasonably affect their participation or safety.
Participation in activities is voluntary.
Eudaimonia may refuse or discontinue a Guest's participation in an activity where, in its reasonable judgement, participation would present a significant safety risk to the Guest, other participants, staff, guides or third parties.
Guests must follow all reasonable safety instructions provided during the Service.
Ocean activities are subject to weather, tides, currents, visibility and other environmental conditions, and wildlife encounters can never be guaranteed.
8TRAVEL DOCUMENTS & INSURANCE
The Guest is solely responsible for ensuring that they have all documents required for their travel, including:
- a valid passport;
- any required visa or entry permission;
- flight tickets and travel arrangements;
- required health or vaccination documentation, where applicable;
- travel insurance; and
- any other documents required by the relevant authorities.
Guests travelling to the Maldives are responsible for complying with the entry requirements of the Maldives Immigration authorities, including completing any required Traveller Declaration within the applicable timeframe.
Eudaimonia is not responsible for losses arising from invalid or missing travel documents, denied entry, visa issues, missed flights or failure to comply with applicable immigration or entry requirements, except where such liability cannot legally be excluded.
Comprehensive travel insurance is strongly recommended, including appropriate coverage for medical expenses, cancellation, interruption, lost luggage and activities undertaken during the trip.
Eudaimonia does not provide travel insurance unless explicitly stated otherwise.
9RESPONSIBLE TRAVEL & ENVIRONMENT
Eudaimonia is committed to responsible and respectful travel in the Maldives.
Guests are expected to respect local communities, culture, traditions, wildlife and the marine environment.
During marine activities, Guests must follow responsible wildlife guidelines, including not touching, chasing, feeding, riding or otherwise intentionally disturbing marine animals.
Guests must follow instructions provided by local guides and boat crews regarding wildlife encounters and environmental protection.
We encourage Guests to minimise waste, avoid unnecessary single-use plastics and leave beaches, reefs and other natural areas as they were found.
Eudaimonia reserves the right to modify or discontinue an activity where reasonably necessary for environmental, conservation or safety reasons.
10CODE OF CONDUCT
Guests are expected to behave respectfully towards other participants, local communities, accommodation staff, guides, boat crews and other service providers.
Eudaimonia does not tolerate abusive, threatening, discriminatory, harassing or significantly disruptive behaviour.
Eudaimonia reserves the right to refuse or discontinue participation where a Guest's behaviour creates a safety risk, significantly disrupts the experience of others or violates applicable laws, local customs or reasonable instructions.
In such circumstances, the Guest may be required to leave the Service without being entitled to a refund, subject to any rights the Guest may have under mandatory applicable law or the Specific Booking Conditions.
Any additional costs resulting from such removal, including transportation or accommodation, shall be the responsibility of the Guest.
Guests are responsible for complying with the laws and regulations of the Republic of Maldives.
11PHOTOGRAPHY & MEDIA
Eudaimonia or its authorised photographers, guides or partners may take photographs or videos during trips, retreats, excursions and activities.
Where appropriate, such material may be used for Eudaimonia's website, social media, promotional materials and other marketing purposes.
Guests who do not wish to appear in promotional photography or video should inform Eudaimonia in writing before or during the Service.
Eudaimonia will make reasonable efforts to respect such requests.
Guests who independently take and share photographs or videos remain responsible for respecting the privacy and wishes of other participants.
12INTELLECTUAL PROPERTY
All original content created by or for Eudaimonia, including but not limited to photographs, videos, written content, itineraries, programme descriptions, branding, logos, graphics and other materials, remains the property of Eudaimonia or the relevant rights holder.
Such content may not be copied, reproduced, distributed, modified or commercially used without prior written permission.
13GOVERNING LAW & DISPUTES
These General Terms & Conditions are governed by the laws of the Republic of Maldives, unless otherwise required by applicable law.
The Guest and Eudaimonia agree to first attempt to resolve any dispute through good-faith communication.
Where a dispute cannot be resolved amicably, it shall be subject to the jurisdiction of the competent courts or authorities of the Republic of Maldives, to the extent permitted by applicable law.
14FINAL PROVISIONS
These General Terms & Conditions, together with any Specific Booking Conditions provided for a particular Service, constitute the terms applicable to the Guest's Booking.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.
Eudaimonia reserves the right to update these General Terms & Conditions from time to time. The version applicable to a Guest's Booking will generally be the version in effect at the time the Booking is confirmed, unless otherwise required by law.
By completing a Booking, the Guest confirms that they have had the opportunity to read these Terms and agrees to be bound by them.
